Strong response needed to LoC firing, Chinese incursions: Ex-Army chief VK Singh

Written By Unknown on Rabu, 28 Agustus 2013 | 08.21

MUMBAI: The five accused arrested in connection with the gang rape of 23-year-old photojournalist were on Wednesday taken to Shakti Mills compound here to reconstruct the sequence of events that led to the crime.

All the five accused were brought to the crime scene at around 1pm and police sought details from them as to what had transpired on the fateful day.

The victim, an intern with an English magazine, was allegedly raped by the five accused when she had gone to the desolate Shakti Mills premises on August 22 with a male colleague on an assignment. Her colleague is a prime witness in the case.

Joint Commissioner of Police (crime) Himanshu Roy, who is supervising the investigation, was also present at Mills when the accused were brought there.

The reconstruction of events that led to the crime is also being video-recorded, police sources said.

All five accused - Salim Ansari, Vijay Jadhav, Chand Babu Sattar Shaikh, Mohammed Kasim Hafiz Shaikh alias Kasim Bengali and Siraj Rehman Khan - are in the custody of the Mumbai Crime Branch.

Police had earlier said that when Salim made a phone call to Kasim Bengali, asking him to immediately reach Shakti mills on the day of the crime, the latter was present in a shanty with Chand, Siraj and one more person. "That person has been found and made a witness in the case," he said.

Yesterday, two teams from Central Forensic Science Laboratory, Delhi, and Gujarat Forensic Science Laboratory, carrying advanced equipment, thoroughly examined the crime scene for nearly three hours to gather evidence to build a water-tight case against the accused.

The team from Gujarat also had two psychiatrists who conducted Layered Voice Analysis (LVA) on the accused. LVA is a technique designed for truth verification and detection of deceit. It helps measure the emotional content of human speech, captured live or extracted from recorded audio.

Police have also conducted searches at the homes of the accused and recovered clothes including undergarments.

Responding to a query about the victim being forced to clean the crime scene after the brutal act, a police official had earlier replied in the affirmative but said plenty of evidence was still collected from the spot.

Fresh rains in Uttarakhand, many key routes remain blocked

DEHRADUN: Light to moderate rains occurred at some places in Uttarakhand on Wednesday, where many key roads continued to be blocked due to recurring incidents of landslides.

The Badrinath highway was again blocked at Patalganga and Maithana following a landslip. This led to suspension of traffic on the route, besides affecting supplies to places like Joshimath, Chamoli and Gopeshwar, the disaster management authorities said.

The route was reopened briefly on Monday after four days of closure, but fresh landslide last night again led to suspension of traffic. BRO personnel are working to remove debris with the help of stone cutting equipment and JCBs.

Though most places across Uttarakhand received light to moderate rains, a few places recorded rather heavy showers.

Haridwar received the maximum 57mm of rains, followed by Kotdwar (43mm), Chamoli (32mm), Dehradun (25mm) and Haldwani (14mm), the MeT department said.

Earlier, state disaster management centre chief Piyush Rautela told that despite all out efforts, it will take a year or even more to drag Uttarakhand out of the effects of the June calamity as vagaries of nature and unique geographical conditions have made the exercise difficult.

"Despite the best of intentions of the personnel engaged in reconstruction efforts, nothing can be expected overnight. The weather is often bad and the hilly terrain in which the roads and bridges are being rebuilt don't let the operations go smoothly," he said.

Forest officer in Tamil Nadu loses 30-year battle over date of birth

CHENNAI: A forest range officer lost his 30-year battle over his date of birth, when the Madras high court refused to order the authorities to alter his year of birth from 1952 to 1956, and consequently to reinstate him in service.

R Mohanasundaram, who retired from service in May 2010, said he should be reinstated because his original year of birth was 1956 and not 1952. Had he succeeded, Mohanasundaram would have re-entered the service and served for four more years before retiring only in 2014.

But his case exposed a fraud of sorts, as an investigation ordered by the Cuddalore district collector revealed that a total of 15 date-of-birth entries for the year 1956 had been tampered with in the Kullanchavadi sub-registrar office.

Mohanasundaram joined the state forest department as forester on August 7, 1981. In April 1983, he submitted an application to the authorities, claiming that his date of birth had been wrongly entered as May 10, 1952 instead of May 10, 1956. Though he kept fighting court cases and corresponding to the principal chief conservator of forests (PCCF) office continually, his case picked up momentum only a few months ahead of his scheduled retirement in 2010.

In January 2010, the forest secretary directed the PCCF to ensure that Mohanasundaram's case was investigated by an officer not below the rank of deputy collector. The court too passed an order recommending an investigation into the matter.

When the Kullanchavadi sub-registrar's office documents were perused, the authorities realised that a total of 15 date of birth entries had either been tampered with or altered. Mohanasundaram's name itself had been conspicuously inserted in the register. Relying on the register entries, a single judge concluded that records had been completed tampered with and hence he could not be ordered to be reinstated in service.

Upholding the single judge order, the first bench comprising acting Chief Justice R K Agrawal and Justice T Raja said: "It was found that serial no. 10 relating to Mohanasundaram's date of birth was inserted at the bottom of page no. 3 in a different ink, while there is already a serial no. 10 at page no. 4. (of the register)."

Prasar Bharti declines to provide info on Pak sought under RTI

LUCKNOW: Why should people be deprived of information related to Pakistan, or about leaders who went to Pakistan prior to Independence? It's one of the most important period of Indian history and information relating to that period should be disclosed said the central information commission in the case pertaining to RTI activist Subhash Agrawal who raised number of queries relating to the recording of the speeches of late Muhammad Ali Jinnah and such other prominent leaders of India who went over to Pakistan in 1947. He was informed by the CPIO, Prasar Bharti, that the recordings could not be disclosed to him because, in the CPIO's opinion, this would be exempted under Section 8(1)(a) of the Right to Information (RTI) Act.

The appellate authority endorsed the stand taken by the CPIO that providing such an information may affect the country's foreign relations, may incite violence or threaten its sovereignty and integrity.

The chief information commissioner (CIC) observed that more than 60 years after Independence, time has come when all concerned must decide what all information realting to the period prior to the independence should be made available to the general public. This has become all the more necessary because of the enactment of the Right to Information (RTI) Act. To keep all the information relating to Pakistan or leaders who went there as secret and confidential is a regressive stand.

The CIC directed the All India Radio undertake an exercise in the next six months to evaluate the recordings available in the archives and to publish, proactively, a list of all such recordings on their website for everyone to know. Prasar Bharti, however, has decided to provide the recordings.

Bill to negate Supreme Court verdict gets Rajya Sabha nod

Written By Unknown on Selasa, 27 Agustus 2013 | 08.20

NEW DELHI: Contending that there was a need to check growing "criminalisation" in politics, Rajya Sabha on Tuesday "unanimously passed" a bill negating a Supreme Court verdict to allow people in jail to contest polls.

Representation of the People (Amendment and Validation) Bill, 2013 provides for a change in the act of 1951. The amendment to sub-clause 5 of section 62 of the RPA, if passed by Parliament, shall come into effect from July 10, 2013, the day the Supreme Court gave its judgement that those in jail can not contest election.

"The fact is that the political class is the most accountable class in the country. Politicians are accountable to Parliament, to the Election Commission, to the country, to the people, to whom we go every after five years. We are the most accountable set of people in the country," Law minister Kapil Sibal said in his reply after a discussion on the bill.

"It is we who have passed the law to make us accountable. It is us who have decided to disclose our assets. Which other institution has taken such steps to make themselves more accountable," he said.

Sibal, who was congratulated by all members for bringing the Bill, said the apex court's order might perhaps not have come had the "environment" been different.

"I dare say, in an another environment, we perhaps would not get such a judgement. The environment is that political class is being looked upon with suspicion," Sibal said.

After examining the Supreme Court order, Government had filed a review petition, but instead of waiting for the outcome, it felt the need to "suitably" address the situation.

Over 40 Auschwitz guards to face German justice: Newspaper report

German investigators into Nazi war crimes will send the files of more than 40 former Auschwitz death camp personnel to state prosecutors from next month, a newspaper reported on Tuesday.

Most of the suspects are aged in their 90s and they live in all parts of Germany including the former communist east, chief investigator Kurt Schrimm told the Tageszeitung.

The list of alleged guards at the concentration and extermination camp in what was Nazi-occupied Poland initially contained 50 names, but some of them have since died.

"These accused have so far not been informed", that they are now in the crosshairs of justice, said Schrimm, senior prosecutor at the central office for resolving national socialist crimes.

More than 6,000 SS personnel served at Auschwitz, where, about 1.1 million Jews, Roma and Sinti and members of other persecuted groups died in gas chambers or of forced labour, sickness and starvation.

For over 60 years, German courts only prosecuted Nazi war criminals if evidence showed they had personally committed atrocities, but since a 2011 landmark case, all former camp guards can be tried.

In that year, a Munich court sentenced John Demjanjuk to five years in prison for complicity in the extermination of more than 28,000 Jews at the Sobibor camp, where he had served as a guard.

The investigative office, set up in 1958, has carried out more than 7,000 probes but has no powers to charge suspects itself. Instead, it sends case files to regional prosecutors who then decide whether to pursue suspects, who must also be judged fit to stand trial by the courts.

Malala Yousafzai awarded 2013 International Children's Peace Prize

AMSTERDAM: Teenage activist MalalaYousafzai, shot in the head by a Taliban militant last October after campaigning for girls' right to education, has won the prestigious International Children's Peace Prize, KidsRights announced on Tuesday.

The Pakistani 16-year-old will receive the award from 2011 Nobel Peace Prize winner and women's rights campaigner TawakkolKarman at a glittering ceremony in The Hague on September 6, the Amsterdam-based organization said.

Malala "risked her life in the fight for access to education for girls all over the world", KidsRights said in a statement.

"By awarding the 2013 International Children's Peace Prize ... KidsRights shines the spotlight on a brave and talented child who has demonstrated special dedication to children's rights," it added.

The passionate advocate for girls' education was shot in the head by a Taliban gunman while on a school bus near her home in Pakistan's Swat valley last year.

She was given life-saving treatment in Britain where she now lives, but the attack galvanized her campaign for greater educational opportunities for girls.

Malala's brave fight-back from her injuries, and her speech at the United Nations in July, have made her a leading contender for this year's Nobel Peace Prize.

But the response to her in Pakistan has been mixed, with many hailing her as a national heroine while others have criticised her for promoting a "Western" agenda.

The International Children's Peace Prize, an initiative of the Dutch-based KidsRights Foundation, was launched in 2005 by former Soviet leader Mikhail Gorbachev, when he chaired the Summit of Nobel Peace Laureates in Rome.

It carries a cash value of 100,000 euros ($133,000) that is invested in projects relating to the winner's cause.

Last year's winner was 13-year-old Cris "Kesz" Valdez for his work with Filipino street children while he himself was destitute.

Cris received the prize from South African peace icon and Nobel Peace laureate Desmond Tutu, who is the award's patron.

VHP yatra: Allahabad HC orders release of Ashok Singhal, Praveen Togadia

Written By Unknown on Senin, 26 Agustus 2013 | 08.21

LUCKNOW: Even as Vishwa Hindu Parishad (VHP) activists staged demonstrations across the state to protest Uttar Pradesh government's crackdown on the 84-kosi yatra , the Lucknow bench of Allahabad high court has directed the state government to release top VHP leaders Ashok Singhal, Praveen Togadia and Swami Rambhadracharya. They were arrested on Sunday along with 2096 others for violating the ban on VHP's 84-kosi yatra and on charges of breach of peace.

The release order was passed by a division bench of Justice ImtiyazMurtaza and Justice DK Upadhayaya on a habeas corpus petition filed by local lawyer RanjanaAginihotri. The court said that if there is no other case pending against the three leaders, the state government should release them immediately.

While Singhal was arrested in Lucknow, Togadia and Rambhadracharya were detained in Ayodhya. They had come to participate in VHP's yatra to garner support for the construction of Ram temple at the disputed site in Ayodhya.

On behalf of the petitioner, advocate HS Jain argued that the three leaders were arrested for violation of section 151 of the Criminal Procedure Code which allows arrest to prevent the commission of cognizable offences. However, as per the law, no person arrested under section 151 can be detained in custody for a period exceeding 24 four hours from the time of his arrest unless his/her further detention is required or authorised under any other provisions of the Code or of any other law for the time being in force. The state government lawyers failed to reply to the queries posed by the court.

Meanwhile, VHP activists protested across the state against the UP government attempts to foil the yatra. The government had banned the yatra on grounds that it may create law and order problem and violate the Supreme Court order to maintain status quo at the disputed site in Ayodhya.

The high court had also upheld the state government's decision. However, despite that, VHP took out the yatra forcing the government to arrest its activists across the state. The government had said all those arrested would be kept in 14-day judicial custody till the date on which the yatra is to conclude, because of possibility that, if released, they would participate in yatra again.

Sources said that the state government was contemplating slapping some more cases against the three VHP leaders or arrest them again soon after the release if they tried to proceed for the yatra again.

Two TDP MPs suspended from Rajya Sabha for a day

NEW DELHI: Cracking the whip, RajyaSabha deputy chairman PJKurien on Monday suspended two TDP members from Andhra Pradesh for a day for continuously disrupting the House by protesting against the decision to form Telangana.

CM Ramesh and YR Chowdhary were suspended under Rule 255 which states that "the chairman may direct any member whose conduct is in his opinion grossly disorderly to withdraw immediately from the Council and any member so ordered to withdraw shall do so forthwith and shall absent himself during the remainder of the day's meeting."

The action came after Ramesh and Chowdhary trooped into the Well during the post-lunch session holding placards as part of their continuous protests since the monsoon session began on August 5.

Kurien gave Chowdhury three minutes to speak with the condition that he and his party colleague would not come to the Well after that.

But, both the TDP members kept protesting with Chowdhury demanding a statement from the government on the issue.

Kurien's repeated appeal to them to go back to their seats and allow functioning of the House went in vain and he suspended them invoking the Rule 255.

He then adjourned the House for 30 minutes. The two TDP members have been protesting against division of Andhra Pradesh since the beginning of the current session. Earlier too, they were warned of such an action "for holding the House to ransom."

Speaking at the event, chief minister Vijay Bahuguna said the calamity had claimed lives of 5,000 people, both from his state and outside, and that normalcy will be back soon.

He thanked the President for intervening and getting the Indian Air Force (IAF) deploy its large fleet of Mi-17 helicopters for the "biggest-ever rescue operations done in recent history" in the state.

Talking about the country's economy, the President, himself an ex-finance minister, said he is "not disappointed" by the current economic situation in the country.

He said India has achieved a 7.9 growth rate despite major international financial crisis and the Eurozone crisis.

India should "feel confident", he said, adding, "Yes there are predicaments and hurdles but I am sure we will tide over them. Our long term growth prospects are quite right".

Focusing his attention towards the subject of energy security, the President said India must find out ways to decrease its dependency on conventional sources of energy as our resources in this area are "inadequate".

"India is the fourth biggest consumer of energy in the world, after US, China and Russia. To sustain high levels of consumption, our energy resources are inadequate.

Energy intensity, which is a measure of energy efficiency of an economy, indicates that India uses much more energy to produce one unit of GDP, as compared to nations like UK, Germany, Japan and US.

"To achieve a high growth rate while meeting the energy needs of the population poses a challenge to us. It calls for higher energy production and for devising measures that promote energy efficiency. We must explore alternative energy models to reduce our dependence on conventional sources of energy," he said.

The UPES, established a decade ago, is the country's first university dealing in core energy subjects and it runs 52 specialised programmes in the fields of oil and gas, power, infrastructure, electronics, logistics, information technology and international business.

Muslim forum condemns Samajwadi Party for banning 84-Kosi yatra

LUCKNOW: The Forum for Muslim Studies and Analysis (FMSA) in Aligarh has condemned the SP government's move to ban the 84-KosiParikramaYatra.

According to the forum, Samajwadi Party (SP) supremoMulayam Singh Yadav has dented the communal harmony of the state by banning the 84-KosiParikarmaYatra of VHP.

"In fact, VHP should have been allowed to carry on its parikarma yatra,'' professor Razaullah Khan of the forum was quoted as saying, while presiding over a meeting of Forum for Muslim Studies & Analysis (FMSA) Aligarh at media centre Aligarh, recently.

Khan pointed out that only 200 sadhus were expected to participate in the parikarma but by banning it, the Akhilesh government has turned the atmosphere of state in favour of VHP.

Secretary of the forum, Jasim Mohammad too said that on the one hand, Mulayam Singh Yadav is sharing tea with VHP leaders and on the other hand, he is banning its parlikarma yatra. He said that this drama of 'Noora-Kushti' was pre-planned but the real face of SP has been exposed otherwise — why did the Akhilesh government fail in talking action during the 19 riots that took place in the state?

The forum said that the Hindus of the state are peaceful and if the yatra was not banned then nothing could have happened. It pointed out that religious rights are a fundamental part of the Constitution and everybody should be allowed to perform them. The forum said SP has tried to mobilize its vote bank by banning the yatra but Muslims have understood gameplan of Mulayam Singh Yadav.
