Veteran choreographer R Raghuram passes away in Chennai

CHENNAI: Veteran choreographer-actor R Raghuram died here on Saturday following a brief illness. He was 64.

Raghuram was not keeping well for the past few days, sources close to his family said.

He is survived by his wife and a daughter named Gayathri, who is also an actor and choreographer.

Fondly addressed as "Raghu Master", he had worked in number of films including those of superstars Rajinikanth and Kamal Haasan.

He had also acted with Haasan in some movies including his hit 'Dasavatharam' a few years ago.

Various film industry members, including choreographers, paid tribute to Raghuram, condoling his demise as a great loss to Tamil cinema.

Night temperature continues to remain very low in various parts of Kashmir

SRINAGAR: Jammu and Kashmir continued to reel under cold wave conditions as the night temperatures witnessed a sharp dip on Friday night with Leh town recording a temperature of minus 11.4 degrees Celsius, a met department official said here.

He added that the nearby Kargil town recorded a low of minus 7.8 degrees Celsius, a drop of two degrees compared to Friday's temperature.

The minimum temperature in the summer capital Srinagar dropped nearly one degree to settle at a low of minus 2.7 degrees Celsius, the official said, adding it was two degrees below the normal for this part of the season.

He said that the night temperature in Pahalgam, a tourist resort which serves as a base camp during annual Amarnath yatra in south Kashmir, dipped to settle at a low of minus 4.6 degrees Celsius.

The famous ski-resort of Gulmarg recorded a low of minus 0.2 degree Celsius, as against last night's minus 0.5 degree Celsius.

The minimum temperature in Kupwara, in north Kashmir, dipped to a low of minus 3.5 degrees Celsius, while Qazigund - the gateway town to Kashmir recorded a low of minus 3.1 degrees Celsius, the official added.

The south Kashmir town of Kokernag also witnessed a sub zero temperature as mercury fell to minus 0.6 degrees Celsius compared to yesterday's 0.7 degrees Celsius.

Kashmir valley and Ladakh region is in the grip of intense cold since the beginning of this month following early snowfall in the high altitude areas.

Jayalalithaa should apologize to Kanchi seers: Subramanian Swamy

CHENNAI: BJP leader Subramanian Swamy on Saturday said Tamil Nadu chief minister Jayalalithaa should apologize to the Kanchi Mutt seers after a Puducherry court acquitted them of murder charges.

Swamy visited the Mutt and received Swami Sri Jayendra Saraswati.

In a huge relief to the pontiffs of the Mutt — Jayendra Saraswathi and Vijayendra Saraswathi — a Puducherry court on Wednesday acquitted them in the sensational case of murder of a temple official in Kancheepuram in Tamil Nadu in 2004.

Swamy has consistently campaigned against Tamil Nadu government for allegedly foisting a false murder case against Acharyas.

Later, he met both the senior and junior Shankaracharyas separately.

Talking to reporters at the Mutt, he said Jayalalithaa should apologize to the Acharyas.

India exported Rs 2.32 lakh crore agricultural produce this year

GANGTOK: Agriculture Minister Sharad Pawar on Saturday said the country exported agricultural produce worth Rs 2.32 lakh crore this year after addressing the consumption need of 1.2 billion population and stocking foodgrain much above the buffer norms.

Addressing a function at the College of Agriculture Engineering and Post Harvest Technology near Ranipool in Sikkim today, Pawar said India is today highest producer of milk, pulses, jute and second in the production of rice, wheat, sugarcane, groundnuts, vegetable foods and cotton in the world.

"It is also the leading producer of spices and plantation crops as well as livestock, fisheries and poultry. India is thus emerging as a major player in the international market," he said.

The credit for this goes to farming community, scientists, technologists and the state governments, he added.

Nepali Congress asks Maoists, other parties to join coalition

KATHMANDU: The Nepali Congress, which emerged the largest party in the Constituent Assembly polls, today asked the Maoists and other political parties to join a coalition government to be formed under its leadership.

"We want the Maoists and other political parties to join the coalition government to be formed under our leadership," Nepali Congress President Sushil Koirala told PTI at his residence at Maharajgunj on the outskirts of Kathmandu.

"I have talked to UCPN-Maoist chief Prachanda and CPN-UML chairman Jhalanath Khanal and sought their cooperation in drafting the Constitution," he said. "I have also held talks with other political parties regarding the matter."

The Nepali Congress bagged 105 seats of the 240 directly elected seats in the November 19 polls but lacks a clear majority to form government on its own.

The CPN-UML was the second largest party with 91 seats followed by Prachanda's UCPN-Maoist, which grabbed 26 seats in the 601-member Constituent Assembly. However, the Maoists have threatened to boycott the Constituent Assembly.

"If we follow democratic tradition, the Nepali Congress should lead the next government as the people have given a mandate to form a government under the leadership of Nepali Congress," Koirala reasoned.

He said the issue of governance and federal structure - that led to the dissolution of the first Constituent Assembly elected in 2008 without drafting the Constitution - would be settled through negotiations.

"The matters relating to the forms of governance and federal structure need to be settled through dialogue before promulgating the Constitution," Koirala said.

"My emphasis is to include all the political parties in the process of drafting the Constitution, and there should be collaboration, consensus and cooperation among the parties in this matter."

Koirala said he did not think there would be "big disputes" among political parties in drafting the Constitution as they had settled most of the contentious issues during the first Constituent Assembly.

The Nepali Congress favours a parliamentary system of governance in which the Prime Minister is accountable to the parliament as this is good to keep checks and balances on power, Koirala said.

"We do not favour the presidential system, which may lead to a kind of dictatorship in a country like ours," he cautioned.

Yercaud byelection: Central forces to be deployed in 120 locations

CHENNAI: The Election Commission has taken a few stringent measures to ensure a free, fair and transparent election in Yercaud assembly constituency on December 4.

In a statement, chief electoral officer Praveen Kumar said each polling station would be covered by local police. In addition, all the 120 polling station locations will have central police force personnel stationed throughout the poll day.

He said an additional armed reserve force would be stationed in 61 locations, where there is either a sensitive polling station or there are four or more polling stations. "Forty three striking forces at various levels will be deployed in readiness for redressing any emergency situation. The zonal parties will have a mobile police force along with them," he said.

Live recording of the proceedings would be carried out at all the 290 polling stations. Direct live webcasting will be done from 269 polling stations which have connectivity.

The proceedings will be videographed in the remaining 21 polling stations, which don't have connectivity.

A room would be provided at the Salem collectorate for one representative of each candidate to monitor the webcasting on the poll day. Central Government officials stationed at the polling stations would serve as micro observers at 21 places where live webcasting is not possible.

Intelligence Bureau warns of rise in Naxalite activity after 'peaceful' polls

RAIPUR: With the latest Maoist offensive claiming lives of four CRPF personnel in Bastar, Intelligence Bureau has alerted security forces, asking them to be extra cautious following inputs of major strikes in southern Chhattisgarh after 'peaceful' assembly election.

Earlier this week, the state IB had intimated district superintendents of police and commandants of armed forces that Maoists are observing "martyrdom week" from November 24-30 in the memory of their slain leader Kishenji during which they may step up their operations.

Kishenji was killed on November 24, 2011 in West Bengal in a special operation conducted by a joint squad of the state police and CRPF.

An advisory by IB also said that ultras will observe the Peoples' Liberation Guerrilla Army week from December 2-8 in honour of slain leaders of the CPI (Maoist), during which again they are likely to intensify and execute attacks on security forces, police stations, camps and also disrupt vehicular movement.

"Even when elaborate inputs were conveyed apprehending that Naxalites may trigger some strikes during this week, such an incident (killing of four CRPF jawans) happened," a senior IB official told PTI requesting anonymity.

The jawans were killed when Naxalites ambushed a road opening party of the security forces in Maoist-infested Bijapur district on Wednesday.

"Now security forces have been told to be more cautious anticipating more such attacks and not to take the situation lightly because of a successful election," he said adding, they were told to stay prepared and strictly follow standard operating procedures (SOPs).

According to the advisory, the IB has called for heightening security around police stations, check posts and camps and conducting area domination within five kilometres radius of these places.

It also asked police jawans and officials to refrain from roaming alone in the region.

Carefully mobilizing on the tip-off about the movement of Naxalites as they may lay ambush in those areas are other precautions given to security forces, according to the IB document.

Twelve constituencies of Bastar division went to polls on November 11 in the first phase of assembly elections amid high security. No major violence was reported on the day in the region except the killing of a CRPF trooper in Dantewada district of south Bastar.

However, on November 12 two Border Security Force personnel and a civilian driver were killed when Naxalites blew up their SUV vehicles near Kerlapal camp while troopers were returning after security deployment for polling in Sukma district.

A record 77 per cent voting was recorded in the just concluded two-phase state assembly elections.

Night temperature stays below freezing point in Kashmir

SRINAGAR: Cold wave conditions continued in Kashmir as the weather remained dry and the night temperature in Ladakh region and most parts of the Valley stayed below freezing point.

The minimum temperatures are expected to fall further as the met department has said the weather would remain dry for a few more days.

Leh recorded a night temperature of minus 9.7 degrees Celsius against the previous night's minus 9.9 degrees Celsius, a met department official said here.

He said the nearby Kargil town, where the minimum temperature settled at minus 5.4 degrees Celsius on Thursday, recorded a low of minus 5.8 degrees Celsius on Friday.

The minimum in summer capital Srinagar remained same as the previous night's low of minus 1.8 degrees Celsius, the official said, adding it was one degree below the normal for this part of the season.

Govt reduces threshold limit of mandatory e- payment from Rs 10L to Rs 1L

PUNE: The government has now decided to reduce the threshold limit of mandatory e- payment from Rs 10 lakh to Rs 1 lakh for both central excise and service tax payment with effect from January 1, 2014. Notification no. 15/2013-CE ( NT) 22.11.13 and 16/2013- Service Tax 22.11.13 has been issued by the government to notify these changes.

Thus, from January 1, 2014 , a manufacturer or a service tax payer who has paid a duty or tax of more than Rs 1 lakh in the previous financial year shall be required to pay duty or tax through internet banking, said a statement issued by the government. This step has been taken as measure of trade facilitation and it is expected that increased coverage of e-payment would make it convenient for the trade to pay taxes electronically.

Currently, a manufacturer is required to pay duty of central excise through internet banking (ie e- payment) if the total duty paid by the manufacturer exceeds Rs 10 lakh in the previous financial year as per rule 8 of the Central Excise Rules, 2002. A service provider is also required to pay service tax through internet banking (ie. e-payment) if the total tax paid by the service provider exceeds Rs 10 lakh in the previous financial year as per rule 6 of the Service Tax Rules, 1994.

Tamil Nadu government ready to take over private medical college

CHENNAI: The Tamil Nadu government has informed the Madras high court that it was ready to take over the DD Medical College and DD Hospital without any liability if the court issues a direction to that effect.

A submission to this effect was made before Justice K K Sasidharan by advocate-general of Tamil Nadu A L Somayaji on Thursday, when writ petitions of students seeking a direction to the state government to take over and administer the college came up for hearing. Another writ petition filed by the college management challenging a Medical Council of India order dated October 14 on student admission was also part of the batch.

"The state government is prepared to consider taking over DD Medical College and DD Hospital, provided the assets and liabilities of the institution are disclosed. The advocate-general made a further statement that in case this court directs the state government to take over the institution, the government is prepared to take over the institution without liability," said Justice Sasidharan, while reserving orders in the matter.

The judge, who had already reserved the matter for orders last week, posted the matter for further hearing on November 27 after advocate-general Somayaji mentioned the matter on November 25 stating that he wanted to make a statement on behalf of the state government. The matter was then adjourned to Thursday, when Somayaji said government was prepared to take over the institution without liability.

When senior counsel for the college V Prakash said that the issue of takeover of the college was now pending before the Supreme Court, senior counsel Nalini Chidambaram representing students welfare association clarified that no such SLP was pending in the apex court as it had already granted students liberty to move the high court for takeover of the institution. She said she would circulate the Supreme Court orders on November 29.

Kochi-Mangalore gas pipeline: Environment ministry to oppose any damage to agricultural lands

CHENNAI: Union environment minister Jayanthi Natarajan on Thursday said her ministry will express opposition if there was any damage caused to agricultural lands or environment under the Kochi-Mangalore gas pipeline.

"We will surely express our opposition if there is any damage to farmlands or environment," she said.

Natarajan was responding to reporters' queries here on the Madras high court green-flagging the GAIL initiative.

She, however, added that it should be seen what has been said in the High Court judgement and "then we will take action accordingly."

The Madras high court had on November 25 quashed a state government order restraining implementation of Kochi-Mangalore gas pipeline project passing through agricultural lands in seven districts of Tamil Nadu.

Demands have been made from various quarters that the state government appeal against the High Court verdict.

Unrest among sugarcane farmers and sugar factory owners an annual affair in Karnataka

BANGALORE: The unrest among sugarcane growers and sugar factory owners in Karnataka has become an annual affair.

This year too, it has remained unresolved and the issue has taken a serious turn, after a farmer committed suicide at Belgaum on Wednesday.

Year-on-year, consensus continues to elude between the farmers and the sugar factory owners over the issue of price. For the government of the day, it's a prickly issue. It can't ignore the farmers, but at the same time can't act strong against the strong sugar lobby, which is run or controlled by politicians from all parties.

The state government's woes have increased after 2009. Since October 2009, the Central government authorized the state governments to fix State Advisory Price (SAP) for sugarcane. In 2010, it delegated its powers to the states to fix SAP based on sugar recovery, by amending section 3 (3C) of the Essential Commodities Act. Among 18 sugarcane growing states, 14 has implemented SAP since 2009-10 including UP, MP and Uttarakhand. In 2013, Karnataka has enacted the Karnataka Sugarcane (Purchase and Supply Control) Act 2013 and constituted the Sugarcane Control Board. The board, which has met a couple of times in the last one month, has failed to resolve the crisis. Initially, it suggested Rs 2,400 per tonne. But, it was rejected both by the mills and farmers. Later, due to protests, it revised it to Rs 2,500 per tonne, but even this didn't make anybody happy.

The growers say the managements give false figures on conversion cost and income from sugarcane, but in reality make profits from sugarcane by-products such as molasses and bagasse.

Sugar mills usually begin crushing operations by mid November and continue till the sugarcane is exhausted. Following the farmers' demand, this year, mills in the north Karnataka region stopped crushing a month ago.

Karnataka CM orders magistrate probe into farmer's suicide

BELGAUM: Chief minister Siddaramaiah on Thursday announced a magisterial inquiry into the suicide of farmer Vittal Bhimappa Arabhavi and gave an assurance to take punitive action against sugar factory managements, who fail to comply with the minimum support price (MSP) of Rs 2,500 per tonne fixed.

The inquiry will look into the circumstances under which Arabhavi committed suicide by consuming pesticide. The suggestion to hold a magisterial inquiry was made by Congress MLA K R Ramesh Kumar, who at the fag end of the debate in the legislative assembly, said the BJP had charged the CM with ""murder'' of a farmer.

"I don't want to go into details of how Arabhavi died, But when an unnatural death takes place, the police will have to register a complaint, how the pesticide was available to the farmer, whether he was compelled by someone,'' Kumar added.

A day after Arabhavi's suicide in front of Suvarna Vidhana Soudha, Siddaramaiah came back strongly and made a statement in legislative assembly.

The CM, who looked down and out on Wednesday after the farmer's suicide, hit back at the opposition parties, particularly BJP. Armed with the statistics, Siddaramaiah spelt out number of suicides committed by farmers during BJP regime between 2008-2013, when former CM BS Yeddyurappa accused Congress government responsible for farmer's death.

The statistics provided by the CM read as many as 180 farmers committed suicide during 2008-09, 140 in 2009-10, 117 in 2010-11 and 117 in 2011-12. "So many farmers committed suicide during BJP regime, did anyone of the CM resigned owing moral responsibility? No government will abet suicide," he said.

Continuing his attack, Siddaramaiah said it was Yeddyurappa as CM arrested farmers when they protested against land acquisition in Bellary for airport construction and also in Chamarajanagar for different purpose.

"You remained silent for three days without uttering a word on farmers'. But suddenly, you dropped shaadi bhagya and jumped on to farmers' protest," CM taunted Yeddyurappa.

While BJP initially demanded Siddaramaiah's resignation, the CM received as rare support from the JD(S), who sticked to demanding a debate on the issue than staging a dharna by trouping into well. Siddaramaiah also thanked JD(S) for not politicizing the death of a farmer.

Government issues guidelines for better implementation of RTI Act

RAJKOT: The Department of Personnel and Training (DOPT), Ministry of Personal public Grievances and pensions, government of India, issued a guideline and templates for better implementation of section 4 (1) (b) of the Right to Information Act (RTI) and asked the states and union territories to implement it to bring transparency into the administration at local level.

According to sources, in order to further improve the proactive disclosure, government of India constituted a task force on Suo Moto disclosure in May 2011 which included representatives of civil society organizations active in the field of RTI.

Sources said that section 4 (1) (b) of the RTI act lays down the information which should be disclosed by public authorities on pro active basis. The purpose of the pro active disclosure is to place large amount of information in public domain on a proactive basis to make functioning of the public authorities more transparent and also to reduce the need for filling individual RTI applications.

Though, experiences suggests that governments have not been implementing it and people have to file RTI applications which ideally should be available on pro-active disclosure where one need not to file an RTI application.

The task force recommended guidelines for disclosure by state governments along with templates for disclosure at various levels. Four Illustrative templates have been recommended for disclosures under Public Distribution System (PDS), Panchayats, MANERGA, Primary and Secondary schools. These four areas have been selected on the ground that they constituent some of the most significant services being provided at the ground level.

"The templates would not only improve the quality of disclosure but would also facilitate more transparency in governance'' says Pankti Jog of Mahiti Adhikar Gujarat Pahel (MAGP), one of the constituents of Task force.

"If the guidelines and templates of pro-active disclosures implemented, it will help a lot to bring transparency in administration and lower the pendency of appeals before the Gujarat Information Commission (GIC) as citizen have to approach to GIC even in matters which should be available on pro-active disclosure'' Jog said.

The templates and guidelines issued by government provide the methods about how the information at local level should be displayed or make available pro-actively.

Sankararaman murder case: Kanchi mutt inmates, relatives of acquitted cheer verdict

PUDUCHERRY: Inmates of Kanchi mutt and relatives of the accused in the sensational Sankararaman murder case clapped their hands and cheered as Puducherry principal district and sessions judge C S Murugan pronounced the verdict acquitting them. Court staff intervened to bring silence to the courtroom.

After the judgment, visibly relieved Kanchi seers Jayendra Saraswathi and Vijayendra Saraswathi, who are the prime accused in the sensational case, were escorted by the police and mutt inmates to their vehicle. Police struggled to clear the mob that surrounded the seers and managed to help them board the vehicle.

The seers and other people preferred not to speak to the media. Relatives of the other acquitted cried profusely and hugging their dear ones. A couple of inmates of the mutt celebrated the acquittal of their spiritual leaders by breaking coconuts at the entrance of the court.

Meanwhile, the advocates' wing of the Viduthalai Chiruthaigal Katchi staged a protest on the premises of the integrated court complex condemning the acquittal of the two seers and 22 others. About a dozen cadres raised slogans criticizing the judgment.

Earlier, delivery of verdict was delayed when two of the accused persons did not appear before the court. After recording the presence of 22 accused persons at 10.27am, the judge gave time for the other two to appear before him. Sylvester Stalin, accused 23, appeared within a few minutes while Dhil Pandian, accused 17, who was involved in another murder case, is absconding.

The judge took the case again at 10.50am and delivered the less than three-page verdict in 15 minutes.

A heavy posse of policemen was deployed on the court premises to prevent any untoward incident.

The names of acquitted persons are - Jayendra Saraswathi, Vijayendra Saraswathi, Sundaresa Iyer, Raghu, Krishnaswamy alias Appu, Kadiravan, Chinna alias Rajnikath, Ambi alias Ambigapathy, Madu Baskar, Kumar, Anand Kumar, Anil Kumar, Meenakshi Sundaram, Palani, Ravi alias Kuruvi Ravi, Arumugam, Dhil Pandian, Satish, Devaraj, Arun, Arumugam, Sekar, Stalin alias Sylvester Stalin and Senthil Kumar.

Centre asks Assam govt to increase security in Bodo areas

NEW DELHI: Warning repeat of 2012 communal clashes, the home ministry has asked the Assam government to tighten security in Bodo dominated areas which have witnessed several killings and kidnapping in recent days.

In a letter, the ministry conveyed to the state government that there have been instances when petty incidents have turned into major clashes resulting in loss of human lives and property.

Reminding that the major clashes between the Bodo and minorities in Assam in 2012 started from a minor incident, the home ministry told the Assam government to nip in the bud such incident by immediately sending forces and providing security to the victims.

More than 100 people lost their lives in the 2012 clashes in Bodo dominated areas in the state.

At least 10 people were killed and six others were kidnapped in separate incidents in Assam in last fortnight.

Curfew was also imposed in Chirang district after police resorted to lathicharge and lobbed teargas shells to disperse a mob which lynched a suspected NDBF terrorist and attacked a police outpost, besides burning down a house here.

Portion of flyover collapses on goods train in Bihar's Muzaffarpur

MUZAFFARPUR: A portion of a flyover with vehicles passing through collapsed on a stationary goods train on Wednesday in Bihar's Muzaffarpur town, injuring seven persons, railway and police sources said.

The 50-feet portion of the flyover caved in at Maripur area of the town, 90 km from state capital Patna, the sources said.

Senior officers are at the accident site, the they said. The injured have been admitted to the Sadar Hospital.

Tassadduq Hussain Jillani appointed Chief Justice of Pakistan

ISLAMABAD: Tassaduq Hussain Jillani, known as a "gentleman judge", was on Wednesday named Pakistan's new Chief Justice, replacing activist judge Iftikhar Chaudhry who led a crusade against corruption and misgovernance.

President Mamnoon Hussain approved Jillani's elevation to the post. His appointment will come into effect from December 12, a day after Chaudhry, the longest serving Chief Justice, retires.

"The President has approved...the appointment of senior most judge Justice Tassaduq Jillani as the Chief Justice of Pakistan with effect from December 12," an official said.

Jillani is a close relative of former premier Yousuf Raza Gilani and a confidante of the outgoing Chief Justice. He is often described as a "gentleman judge" and will serve for nearly seven months.

Chaudhry has built a reputation by strengthening the judiciary, often through direct confrontation with the civilian government and the powerful military.

His actions led to the ouster of former Prime Minister Gilani after he refused to write to Swiss authorities to reopen graft cases against then President Asif Ali Zardari. Many critics had then described it as a "judicial coup".

The slot of the Chief Justice has to automatically go to the senior most judge after the retirement of the incumbent. Neither the President nor the Prime Minister or the government has any role in the nomination of the Chief Justice.

Only the President is to administer oath to the new Chief Justice as per the Constitution.

Born on July 6, 1949, Jillani, hailing from Multan in Punjab, will retire on July 6, 2014, after reaching the age of 65.

After his superannuation, Justice Nasirul Mulk, from Khyber-Pakhtunkhwa, who would then be the senior most judge of the apex court. If he is appointed the Chief Justice, his tenure will last less then 14 months.

Rejecting BJP charge that the Congress had a soft corner for Tejpal, she said that the party has "zero tolerance" against atrocities on women may the one involved is an editor or a chief minister.

"From day one in the Tejpal case, we have made it clear that the Congress does not defend any such behaviour," Oza said.

Party spokesman Randip Singh Surjewala said that both the Congress and the Congress government is committed to protect the safety and dignity of every woman "whether she is being stalked by the chief minister or whether her person is being violated by a journalist editor, both need to be punished."

Petition filed against Sharif in Pakistan for failing to end drone strikes

ISLAMABAD: A contempt of court petition has been filed against Prime Minister Nawaz Sharif and the federal authorities in the Peshawar high court over the government's failure to end US drone strikes.

Jamiat Ulema-e-Islam-Sami's provincial president Maulana Yousuf Shah and former deputy speaker provincial assembly Ikramullah Shahid filed the petition on Monday.

The high court had passed an order in May declaring drone strikes a "war crime". However, drone strikes continue in tribal and adjoining areas.

The Prime Minister and secretary for the ministry of interior were named as respondents.

Defence Council of Pakistan (DPC) chairperson and Ulema-e-Islam-Sami (JUI-S) chief Maulana Samiul Haq said Peshawar, Islamabad and Karachi were not safe after the recent drone strike in Hangu.

DPC is a grouping of extreme right political parties and extremists groups. JuD chief and Lashkar-e-Taiba founder Hafiz Saeed is also part of it.

The petition stated the high court had on May 9 termed the drone strikes a "war crime" and against the sovereignty of the country. The court had directed the government to raise the issue at the United Nations (UN) and to seek compensation for victims of drone attacks.

"If drone strikes are not stopped through diplomatic channels then the federal government needs to shoot down the unmanned aircraft that has been violating the airspace of the country," the petition read, quoting the PHC's previous order.

It added seven months have passed since the order and any action by the federal government is yet to be seen.

"Innocent people are killed in drone strikes which also cause huge property losses to residents of the tribal areas," the Express Tribune quoted the petition as saying.

The Prime Minister, who is the chief executive of the country, is liable to contempt of court proceedings for not following clear orders of the PHC on drone strikes, it added.

It further stated that under Article 204, along with the PM, other concerned officials are also liable of contempt of court

"The DPC had filed a petition at the PHC on November 5, 2011, on which a comprehensive verdict was announced in May this year. The federal government, however, chose to ignore the order which is why contempt of court proceedings need to be initiated against them," said Samiul Haq.

The verdict further directed the government to take up the case in the United Nations Security Council. If the US uses its veto powers, an urgent meeting of the UN General Assembly be called to resolve the issue effectively.

It also stated in case all diplomatic channels fail to bring about the desired result, Pakistan must sever all ties with US and as a mark of protest deny it all logistic and other facilities within Pakistan.

CDFD supplied scientific evidence in Aarushi-Hemraj murder

HYDERABAD: The Centre for DNA Fingerprinting and Diagnostics (CDFD), Hyderabad, and the Central Forensic Science Laboratory (CFSL), New Delhi supplied the scientific evidence in the Aarushi and Hemraj murder by Aarushi's parents Rajesh Talwar and Nupur Talwar who have been sentenced to life imprisonment.

"We got nearly 100 samples from the Central Bureau of Investigation (CBI) and submitted our reports after DNA examination to the court," Dr J Gowrishankar, director, Centre for DNA Fingerprinting and Diagnostics (CDFD) told The Times of India.

Dr Gowrishankar said to what extent the court relied on the scientific evidence submitted would be known only after one goes through the judgement. The special CBI court in Ghaziabad on Monday held the Talwars guilty of the murder Aarushi, their daughter, and their servant Hemraj on May 15-16, 2008. Their sentence was pronounced on Tuesday.

Though the CDFD, an autonomous organisation funded by the Department of Biotechnology (DBT), ministry of science and technology, played an important role in providing DNA evidence in the double murder case, a large number of samples were also examined by the CFSL in New Delhi. Dr Gowrishankar said a staff of the CDFD was also cross-examined in the court about the evidence that was submitted. There was, however, a question about one of the pieces of evidence that was submitted by the CDFD.

"There was an interpolation in labelling of one of the pieces that was sent to us for DNA examination. This was later corrected," Dr Gowrishankar said.

It may be mentioned here that a senior technical examiner with CDFD S P R Prasad had deposed before the sessions court in Ghaziabad with regard to the DNA evidence that the CDFD had to provide. He clarified to the court that the labelling of two pillow covers had been interchanged and a clarification was submitted to the CBI.

Jayalalithaa seeks Prime Minister's intervention to solve power crisis in Tamil Nadu

CHENNAI: Blaming the central agencies for the shortfall in power generation in the state which led to power cuts in districts, Tamil Nadu chief minister Jayalalithaa on Tuesday sought Prime Minister Manmohan Singh's intervention to solve the crisis.

Detailing the measures taken by her government since assuming power in 2011, the chief minister blamed National Thermal Power Corporation (NTPC) and Bharat Heavy Electricals (BHEL) for the present crisis as many plants which supply power to the state are not operating to full capacity due to shortage of coal.

"A joint venture of NTPC and Tangedco which is under NTPC management commissioned two units of 500MW capacity each at Vallur in November, 2012, and in August, 2013. These units were producing about 800MW till recently. Unit 1 with a capacity of 500MW is not in service from November 14 on account of inadequate supply of coal from Talcher coal mines of Mahanadhi Coalfields Limited, a subsidiary of Coal India Limited," she said in a letter to the Prime Minister.

Further, the shortfall in the supply of coal affects not only the Vallur unit but the thermal power stations of Tangedco too. The state units have been able to manage the situation thanks to stock piling of coal, the chief minister said.

Tamil Nadu is receiving only 777MW out of its share of 1113MW from Neyveli Lignite Corporation (NLC) due to repairs and maintenance in some of the units there. Similarly, one unit of Madras Atomic Power Plant and one unit of Kaiga Atomic Power Plant are also not in service resulting in a further shortfall of 241MW. In addition, PPN Limited, which is an independent power project, is out of service due to inadequate supply of naphtha by Indian Oil Corporation Limited. All these have compounded the problem resulting in a shortfall of 2500MW, according to the chief minister.

Criticizing the Centre for not allocating power from surplus states by strengthening the transmission network, the chief minister said, "The government managed to pull the state out of darkness by commissioning its own plants till recently based on which I made a statement in the assembly on the power situation. But the crisis started soon after the statement was made due to the coal shortage."

With regard to the North Chennai thermal unit, the chief minister said an unexplained fire accident took place on November 16 at the 600MW Unit 2 which commenced trial power generation recently. This unit is still under the control of BHEL. Due to this unexplained fire accident, the 600MW Unit 1, which is also still under the control of BHEL and under trial production, had to be isolated, resulting in a further loss of generation of about 600 MW.

The chief minister said, "I, therefore, request you to kindly direct the ministry of power and the ministry of coal to take immediate effective steps to ensure that these power plants under the control of central agencies maximize their generation and restore the supply of power to Tamil Nadu. Continued poor performance by the central PSUs causing shortfall in power supply would only lead the people of Tamil Nadu to come to the conclusion that there is a concerted conspiracy to keep the state in the dark," she said.

Aarushi-Hemraj murder case: Petition for compensation to innocent servants

LUCKNOW: A petition has been moved by IPS officer Amitabh Thakur and social activist Nutan Thakur before chairman, National Human Rights Commission seeking adequate compensation for the unwarranted arrest of three poor servants - Krishna, Rajkumar and Vijay Mondal - by the CBI in an extremely hurried manner in Aarushi-Hemraj Murder case.

The petition also asks for fixing of criminal and administrative responsibility of the CBI officers found responsible for these unwarranted and improper arrests.

Thakurs have made these prayers based on Supreme Court orders in Joginder Singh vs State of UP and Neelbati Behera vs State of Orissa. As per petitioners, the CBI had made arrested the three servants within days of starting investigation but later they were granted bail due to lack of evidence.

The decision of the CBI Court has now proved beyond doubt that these three persons had no connection with the case and they were arrested solely to save the real accused.

CBI opposes SC proposal to appoint amicus curiae in coal scam

NEW DELHI: The Supreme Court's proposal to appoint an eminent lawyer as amicus curiae to assist it in going through CBI's voluminous probe report to brief it on loopholes in the ongoing investigation in coalgate was on Tuesday strongly opposed by the agency saying that its independence will be compromised.

At the outset of the proceedings, senior advocate Amrendra Sharan, appearing for the agency, strongly opposed the suggestion of a apex court bench headed by Justice R M Lodha to appoint amicus, saying it is not acceptable as it would amount to supervising the probe.

"It is bound to interfere in the ongoing probe. It would compromise the independence of the institution if the probe report would be shared with the amicus. The report is meant for the court and no other person be allowed to go through it," he said, adding, "amicus curiae is not acceptable to me".

The bench, also comprising justices Madan B Lokur and Kurian Joseph, said there is no question on supervising the probe and it is just monitoring the investigation.

The bench expressed surprise on why the CBI is so adamant against appointment of amicus saying "it is difficult to understand how it (appointment of amicus) would prejudice or harm the probe".

"If the court is benefited by an objective view of amicus other than you(CBI) then what is the problem," the bench said, noting "You are not appreciating the difficulty faced by us in going through the report and amicus may tell us what has been missed by you."

The bench said that it is not supposed to just go through the report without commenting on it.

The bench on the last hearing had said that it needed assistance to analyse CBI's voluminous coalgate probe reports and suggested appointment of amicus curiae to lend a helping hand to it and had proposed the name of senior advocate T R Andhyarujina.

Advocate Prashant Bhushan, appearing for one of the petitioners on whose plea the apex court monitoring the probe, also raised objection saying that Andhyarujina had earlier represented the Centre and some mines companies.

The bench after hearing all the sides refrained from passing any order and said the issue would be considered later.

SC seeks reply from Centre, states on PIL on kidney problems

NEW DELHI: The Supreme Court on Monday sought response from the Centre and the state governments on a plea for opening a dialysis unit in each district saying two lakh people are losing their lives every year in the country due to kidney problems.

A bench headed by Chief Justice P Sathasivam agreed to hear the PIL and issued notice to the Centre and all the states and asked them to file the response on the plea.

The PIL said number of kidney patients are rising in the country and sought a direction to the states to initiate steps to prevent incidents of kidney failure and related renal diseases by having at least one dialysis centre in each district throughout the country.

It said due to kidney failure, there are two deaths every five minutes, 547 deaths everyday and two lakh deaths annually in the country.

"According to National Kidney Foundation, there are about 7.85 million people are suffering from renal diseases ... out of whom about 31.2 to 41 per cent are having chronic kidney diseases (CKD).

"Only 22.5 per cent of the people suffering from kidney- related diseases get treatment through dialysis. We have about 950 nephrologists across the country available for treatment of renal diseases," the PIL was filed by Sanjeeb Panigrahi said.

The plea also said that according to the estimates of Union health ministry, the country needs at least 50,000 dialysis machines but it has 20 per cent of the requirement.

It also sought direction to take measures to minimise the deaths due to kidney problems.

The PIL said regulations or quality control mechanisms should be ensured for the units run by the private hospitals with respect to the supportive care to provide efficacious medical support to people suffering from chronic kidney/renal diseases and in need of dialysis at regular intervals in their life.

Arvind Kejriwal seeks two more days from EC to reply to its notice

NEW DELHI: Aam Aadmi Party (AAP) convener Arvind Kejriwal on Monday sought two more days time from Election Commission to reply to its notice for Model Code violation by appealing to Muslims in Delhi for votes on religious grounds.

In a letter to the EC, Kejriwal urged it to grant him two more days to reply to the notice. He was served a notice by EC on November 20 after he distributed pamphlets asking Muslims to vote for AAP and was asked to reply by Monday morning.

"The commission has prima facie observed that by distributing the pamphlet (seeking Muslim votes), you have violated the provisions of the Model Code of Conduct. "You are hereby called upon to explain by 11am on November 25 as to why action should not be initiated against you for the said violation," the EC notice said.

The notice to him follows a complaint filed by Harish Khurana, son of former Delhi chief minister Madan Lal Khurana, who objected to pamphlets being distributed by Kejriwal containing appeals to Muslim voters for their backing.

The pamphlet, whose objectionable parts EC has reproduced in its notice, purportedly has AAP saying that, "Delhi's Muslims should support AAP in the forthcoming polls. "We (AAP) are not seeking votes for power or money but for rooting out corruption from the system and building a corruption-free India where people belonging to all religions can live in peace," the pamphlet said.

Kejriwal has appealed in the pamphlet that, "BJP is a communal party. Till now Muslims did not have any alternative, but now they have an honest alternative in the form of AAP. "We appeal to Muslim voters of Delhi to back our endeavours for clean politics and not fall into the trap in which they have been falling for the past 65 years."

The model code prohibits any such appeal before an election which invokes religion or caste for securing votes and says mosques, churches, temples or other places of worship shall not be used as a forum for election propaganda.

Nitish releases eight report card of Bihar govt's performance

PATNA: Bihar chief minister Nitish Kumar on Monday showcased his government's performance on completion of eight years in office, his first sans BJP.

Flanked by his cabinet colleagues, Kumar presented the state government's annual report card at a public function here listing achievements in infrastructure like reducing road journey from far off districts to Patna to a maximum of six hours, boosting monthly footfall in government hospitals to 8,000 and doubling power supply as the high points.

After assuming power on November 25, 2005, Kumar had promised to come up with annual performance report of his government like an examinee to seek score from the masses.

In reply to a question as to how much credit he would give for these achievements to erstwhile NDA partner with whom he parted company on June 16, Kumar avoided a direct reply and said "governance was a continuous process".

He, however, said in fulfilment of his commitment to the voters in 2010 assembly polls, he did not allow any "slowness" in the pace of growth in the state which began eight years ago despite mounting challenges of running 18 ministries himself.

In an apparent dig at the BJP, Kumar said despite their picking holes in the performance of his government, "it is satisfaction of the people about crime-free environment and efficient delivery of services that matters."

With Congress also coming out with its report card to highlight that the state government failed to ensure efficient utilization of central funds, Kumar said the fact was that there had been a delay in release of funds in all flagship schemes of the Union government be it Aganwadi, Indira Awas Yojna or Integrated Child Development Scheme.

Coastal Odisha alerted as cyclone Leher approaches landfall

BHUBANESWAR: Hardly had the dust settled on the devastating Cyclone Phailin ravaging Odisha and Andhra Pradesh's coastal districts, the two states were bracing for another storm "Cyclone Lehar" to strike.

The state government on Monday put district authorities on alert, especially those of 10 southern and coastal districts, as the severe cyclonic storm is expected to make a landfall between Kalingapatnam and Machhlipatnam of Andhra Pradesh at around noon of November 28.

It is now stationed at about 1000-km south-east of Gopalpur, the weather office said.

"We have alerted the Collectors of 10 districts of south and coastal region. Fishermen have been advised not to venture into the sea," Special Relief Commissioner P K Mohapatra told reporters.

He, however, said that the storm, which is expected to pack a wind speed 200kmph during landfall, will have less impact in Odisha than Andhra Pradesh.

As predicted by the MeT department, three coastal districts of Kendrapara, Puri and Jagatsingpur may be affected by the storm while southern districts, including Ganjam, Gajapati, Koraput, Malkangiri, Nabarangpur and Rayagada, may face heavy showers.

"We have asked the district collectors to ensure that the mandis should remain prepared to store paddy and other grains before the disaster strikes," Mohapatra said.

As per the latest MET prediction, Cyclone Lehar over southeast Bay of Bengal has moved westwards with a speed of 15 km/hr.

The system would intensify further into a very severe cyclonic storm and move west-northwestwards and cross the Andhra Pradesh coast between Machillipatnam and Kalingapatnam near the Kakinada coast at around noon of November 28.

The Distant Warning Signal Number Two (DW-II) has been hoisted at Paradip and Gopalpur ports, sources said.

EC initiates inquiry into Arvind Kejriwal's name in two voters' lists

NEW DELHI: The Election Commission on Monday initiated an inquiry into allegation against AAP convener Arvind Kejriwal of being enrolled in voters' list at two assembly constituencies in Delhi and directed the poll officers to file a report within two days.

"Even though we have not received any complaint, but taking cognisance of media reports have asked the district election officers of New Delhi and North-East Delhi to go through the voter enrolment form filed by Kejriwal. They have been asked to file a report in 48 hours," Delhi chief electoral officer Vijay Dev said.

Any further action will be taken after the report is submitted, he said.

The Delhi BJP had approached the Election Commission on Friday against Kejriwal alleging that he was enrolled as a voter in three different constituencies, two in Delhi and one in Uttar Pradesh.

"It has come to our notice that Kejriwal's name has been registered at three places - Seemapuri and New Delhi constituencies in Delhi and Sahibabad of Ghaziabad district in Uttar Pradesh," claimed the BJP spokesperson.

AAP had said it has already informed the EC about the change of address and it is now up to the commission to decide the matter.

"We have already informed EC about it. We have done our job and filled the requisite form, now it is up to EC to decide in the matter," party had said.

Dev on Monday appealed to political parties to contest the election on level playing field and refrain from maligning each other names.

Suspended TMC MP Kunal Ghosh's bail plea rejected, sent to 5-day police custody

KOLKATA: A court on Sunday rejected the bail plea of suspended Trinamool Congress MP Kunal Ghosh, arrested in connection with the Saradha ponzi scam, and sent him to five days police custody.

Additional chief judicial magistrate, Bidhannagar, Apurba Kumar Ghosh, passed the order after Ghosh was produced before him amid tight security.

While Ghosh's counsel sought his bail, the police sought his custody for seven days for further investigation.

The Rajya Sabha member was arrested on Saturday night in connection with the Saradha ponzi scam.

Ghosh, who was suspended from Trinamool Congress for anti-party activities in September, tried to say something to the judge but he was not allowed.

His arrest was made in connection with a complaint filed by the general manager of a company Broadcast Worldwide.

Ghosh, the CEO of Saradha Group's media arm, was charged under sections 420 (cheating), 406 (criminal breach of trust) and 120B (conspiracy) of the IPC.

Ghosh told reporters outside the court that he was on a fast since last night to protest the alleged cruel behaviour of the police towards him.

Before his arrest, the MP had filed an FIR against deputy commissioner of detective department (DCDD) of Bidhannagar Police Commissionerate, Arnab Ghosh, alleging 'criminal blackmailing' by him.

He had alleged that the police officer had asked him to reply to questions which were beyond his comprehension or face arrest.

Isro to launch German, French, British, Canadian satellites

CHENNAI: The Indian Space Research Organisation (ISRO), that got global recognition for its successful launch of a mission to Mars, will now launch German, French, British and Canadaian satellites, a top official said.

"We will be launching EnMAP (Environmental Mapping and Analysis Programme) satellite belonging to Germany. The satellite will weigh around 800 kg," Isro chairman K Radhakrishnan told IANS in an interview.

The EnMAP is a hyperspectral satellite that would provide images of the Earth at regular intervals. This apart, ISRO will be launching French satellite SPOT-7 during the first quarter of 2014, Radhakrishnan said.

"There will be four more small foreign satellites that would go along with SPOT-7," he added.

ISRO had launched the SPOT-6 satellite in 2012.

Radhakrishnan said discussions were held with British agencies for launching three satellites each weighing around 300 kg and also to launch a set of Canadian satellites. The idea is to have at least one commercial launch every year using the Indian Polar Satellite Launch Vehicle (PSLV), the Isro chairman said.

According to him, the PSLV rocket's reliability has been underlined once again with the launch of Mars Orbiter in a precise manner despite the challenges.

Queried about the status of Mars Orbiter, he said: "The Orbiter has been raised to around 193,000 km apogee (farthest point from Earth). We are all gearing up for the dawn of Dec 1 when the Orbiter will be injected in trans-Martian orbit."

ISRO has been switching on the various systems and payloads of the Orbiter to check their functionalities and health.

"All the instruments are working normal. The satellite's health is good," Radhakrishnan said.

India launched on November 5 its first inter-planetary mission to Mars with a two-fold objective - technological and scientific. The project outlay was around Rs 450 crore.

The technological objectives include design and realisation of Mars orbiter with a capability to survive and perform Earth-bound manoeuvres, cruise phase of 300 days, Mars orbit insertion/capture, and on-orbit phase around Mars.

It will also enable deep space communication, navigation, mission planning and management and incorporate autonomous features to handle contingency situations.

The scientific mission will be to explore the Mars surface features, morphology, mineralogy and Martian atmosphere by indigenous scientific instruments.

Radhakrishnan said the Orbiter will be using around 365 kg on board fuel in the orbit raising activities out of around 850 kg fuel on board.

Comparing the latest Mars mission MAVEN of the US, Radhakrishnan said the American Atlas V rocket has a payload capacity of 13 tonnes to GTO (geo-transfer orbit) while the PSLV-XL capacity is only around 1,300 kg.

"The American satellite, weighing around 2,500 kg, carries payload weighing around 65 kg and around 1,600 kg fuel. Our Orbiter weighing 1,350 kg carries a payload of just 15 kg and fuel of around 850 kg," he added.

What he did not compare is the cost incurred in the both the missions. While India will be spending around $72 million the US mission is budgeted at $671 million.

Radhakrishnan reiterated that the Mars mission proves India's capability to undertake such complex tasks.

Saudi Arabia reports 1 more death from new respiratory virus

RIYADH (Saudi Arabia): Saudi Arabia says one more person has died from a new respiratory virus related to SARS, bringing to 55 the number of deaths in the kingdom at the center of the outbreak.

The Health ministry said Sunday that the 37-year-old man died in Riyadh. He was among 130 people who have been infected with the virus in Saudi Arabia since September last year.

The new virus is related to SARS, or severe acute respiratory syndrome, which killed some 800 people in a global outbreak in 2003. It belongs to a family of viruses that most often causes the common cold.

It emerged in the Middle East and can cause rapid kidney failure but doesn't seem as infectious as SARS. It has been dubbed MERS, or Middle East respiratory syndrome.

Japan warns of 'unpredictable events' over China's new air zone

TOKYO: Japan warned Sunday of the danger of "unpredictable events" and South Korea voiced regret following China's unilateral declaration of an air defence zone over areas claimed by Tokyo and Seoul.

Japanese foreign minister Fumio Kishida said his country was considering making stronger protests "at a higher level" after China announced Saturday it was setting up the zone over an area that includes Tokyo-controlled islands claimed by Beijing.

US secretary of state John Kerry and secretary of defence Chuck Hagel said on Saturday they were "deeply concerned" at China's move and were committed to defending Japan.

China said it was setting up the "air defence identification zone" over an area including the islands in the East China Sea to guard against "potential air threats".

It released a set of aircraft identification rules that must be followed by planes entering the area.

Kishida told reporters Japan cannot accept the Chinese measure, calling it "a one-sided action which leads us to assume the danger of unpredictable events on the spot".

In Seoul, South Korea's defence ministry said the Chinese zone partly overlapped its own.

"We find it regretful that China's air defence zone partly overlaps with our military's Korean Air Defense Identification Zone (KADIZ) in the area west of Jeju Island," said a ministry statement, according to Yonhap news agency.

"We will discuss with China the issue so as to prevent its establishment from affecting our national interests."

A military source quoted by Yonhap said the overlapping area is 20 km wide and 115 km long.

The Chinese zone also includes the South Korean-controlled submerged rock that lies within the two countries' overlapping economic zones, according to a defence ministry official quoted by the news agency.

The dispute over the islands, known as the Senkakus in Japan and the Diaoyus in China, heated up last year when Japan's government bought some of them from a private owner.

China has since sent coastguard vessels and other state-owned ships as well as aircraft close to the islands, sometimes breaching airspace and territorial waters around them.

This has prompted Japanese coastguard boats and air force fighter jets to try to warn them off.

The Japanese defence ministry said Saturday two Chinese planes entered Japan's own air defence identification zone over the East China Sea, prompting its air defence force to scramble fighter aircraft.

The ministry lodged a strong protest with a minister at the Chinese embassy in Tokyo by telephone.

Defense secretary Hagel reiterated that the islands fall under the US-Japan security treaty, meaning that Washington would defend its ally Tokyo if the area is attacked.

He made it clear that the United States, which stations more than 70,000 troops in Japan and South Korea, would not respect China's declaration of control over the zone.

However Washington has repeatedly said it takes no position on the islands' ultimate sovereignty.

Japan has vowed not to cede sovereignty or even to acknowledge a dispute with China over the islands.

It accuses its neighbour of trying to change the status quo through intimidation.

Former Japanese foreign minister Masahiko Komura, speaking as deputy head of the ruling Liberal Democratic Party, said defence officials of the two countries must keep in close communication "to prevent a touch-and-go situation from arising".

"China used to maintain a certain degree of restraint in the past although it insisted that the Senkaku islands were part of its territory," Komura, who served as foreign minister from 1998-1999 and from 2007-2008, told public broadcaster NHK.

"But it is a serious matter that Chinese ships have recently intruded into the territorial waters and that China declared the air defence identification zone this time."

Ban says Iran nuclear deal potentially 'historic'

UNITED NATIONS: UN leader Ban Ki-moon said Sunday that a nuclear deal struck by international powers with Iran could be "historic" for the Middle East, his spokesman said.

Ban "warmly welcomes" the preliminary accord under which Iran agreed to limit its uranium enrichment in return for sanctions relief, said the UN spokesman Martin Nesirky.

Ban said the accord "could turn out to be the beginnings of a historic agreement for the peoples and nations of the Middle East region and beyond."

Iran struck the deal with the United States, Russia, China, Britain, France and Germany, and Ban said all sides must work on "creating mutual confidence and allowing continued negotiations to extend the scope of this initial agreement."

The Elders, a group of former world leaders, also welcomed the accord, but called for swift followup measures to make sure it is carried out.

"We are all aware of the risks involved," said Jimmy Carter, former US president who clashed with Iran during his term of office.

"But I am convinced that, after 35 years of animosity and distrust, there is an historic opportunity to rebuild relations with the government and people of Iran on solid foundations of mutual respect," Carter said in a statement released by his group.
