CHENNAI: A forest range officer lost his 30-year battle over his date of birth, when the Madras high court refused to order the authorities to alter his year of birth from 1952 to 1956, and consequently to reinstate him in service.

R Mohanasundaram, who retired from service in May 2010, said he should be reinstated because his original year of birth was 1956 and not 1952. Had he succeeded, Mohanasundaram would have re-entered the service and served for four more years before retiring only in 2014.

But his case exposed a fraud of sorts, as an investigation ordered by the Cuddalore district collector revealed that a total of 15 date-of-birth entries for the year 1956 had been tampered with in the Kullanchavadi sub-registrar office.

Mohanasundaram joined the state forest department as forester on August 7, 1981. In April 1983, he submitted an application to the authorities, claiming that his date of birth had been wrongly entered as May 10, 1952 instead of May 10, 1956. Though he kept fighting court cases and corresponding to the principal chief conservator of forests (PCCF) office continually, his case picked up momentum only a few months ahead of his scheduled retirement in 2010.

In January 2010, the forest secretary directed the PCCF to ensure that Mohanasundaram's case was investigated by an officer not below the rank of deputy collector. The court too passed an order recommending an investigation into the matter.

When the Kullanchavadi sub-registrar's office documents were perused, the authorities realised that a total of 15 date of birth entries had either been tampered with or altered. Mohanasundaram's name itself had been conspicuously inserted in the register. Relying on the register entries, a single judge concluded that records had been completed tampered with and hence he could not be ordered to be reinstated in service.

Upholding the single judge order, the first bench comprising acting Chief Justice R K Agrawal and Justice T Raja said: "It was found that serial no. 10 relating to Mohanasundaram's date of birth was inserted at the bottom of page no. 3 in a different ink, while there is already a serial no. 10 at page no. 4. (of the register)."
