The first bench comprising Chief Justice Sanjay Kishan Kaul and Justice M Sathyanarayanan, passing orders on a public interest litigation filed by PIL-activist Traffic Ramaswamy, said: "Civic sense must begin from one's own home and work place... No purpose will be served by issuing impractical directions."
Ramaswamy had said in his petition that Ganesh idols were allowed to be erected in the middle of roads and organisers were allowed to steal electricity during celebrations. Officials were issuing permissions though there were no rules to do so, he said.
On Monday, the bench said officials were washing their hands off the menace. "The municipal corporation has washed its hands off by stating that it is not concerned about it and that it had not granted any permission. The affidavit of the electricity department is equally self-serving, where it says if any unauthorised tapping is pointed out, action will be taken as and when noticed."
Referring to a September 10, 2005, memorandum issued by the DGP asking all district authorities to insist on no-objection certificates for such functions, the first bench said: "Needless to say government authorities must follow their own circulars, including the memorandum dated September 10, 2005, issued by the DGP pointed out to us which is stated to be still in force."
The judges then said authorities concerned must ensure that religious functions are properly organised, causing least inconvenience to residents, in terms of decibel level of speakers as well as any passage from one place to another.
