A division bench consisting of Justice A Selvam and Justice V S Ravi dismissed the PIL filed by Madurai-based advocate Kumaravel. In his PIL, Kumaravel cited Tamil Nadu assembly's resolution which demanded India boycott GHOGM.
Dismissing the petition, the bench observed that the court didn't have expertise to analyze the issue since the matter touched upon the foreign policy of the government.
It may be remembered that another division bench of the high court heard this PIL a week ago. When an order was about to be passed on the petition by that bench, it was transferred to another division bench as requested by the petitioner's side.
On Monday, petitioner's counsel W Peter Ramesh Kumar told the division bench of justices A Selvam and V S Ravi that though the state's resolution, passed with the support of all the 234 MLAs of the state assembly on October 24, was sent to the Central government's cabinet secretary on the same day, there was no reply. He argued that the Centre should have sent a reply. Hence, he requested the court to intervene in the matter and pass orders to restrain the government from attending the summit.
In his reply, assistant solicitor general K K Senthilvelan argued that attending the summit was the policy decision of the Central Government. He said the high court's principal seat dismissed a PIL on the same issue on October 29. Following this, the division bench posted the matter to November 13 for orders. When the matter came up on Wednesday, it dismissed the PIL.
